Except as otherwise expressly provided in writing by Incognito Wear IX . (hereinafter “Incognito”), the only warranties applying to products or materials sold are those, if any, specifically stated herein by Incognito. Incognito makes no warranties expressed or implied, of performance, merchantability, workmanship, quality, durability or suitability, of its products, including those instances where changes, alterations or modifications are made in materials at the request or instruction of the purchaser.
To the full extent permitted by law, Incognito disclaims any and all representations and warranties with respect to any and all products sold by Incognito, whether express or implied, including but not limited to, warranties of title, merchantability, fitness for a particular purpose or use, and non-infringement. Neither Incognito, nor its officers, directors, employees, shareholders, or agents will be liable for any direct or indirect damages or losses of any kind arising out of or in connection with the products sold by Incognito of your use thereof, including your inability to use any products purchased from Incognito.
This limitation of liability applies to all damages and losses of every kind, including but not limited to, direct, indirect, incidental, special, punitive, and consequential damages, whether arising in contract or tort, and even if Incognito should have known of the possibility of such damages. Incognito’s obligation is limited to the repair or replacement of defective products or parts reported to Incognito within ten (10) days of delivery of the product.
In addition to the above damages disclaimed, Incognito specifically disclaims any and all liability for accident, injury, and/or death that may occur in association with the use of any Incognito products. All individuals should obtain substantial training from a properly qualified firearms instructor before using any firearm for any purpose.
Great care should be used when handling, storing, or transporting firearms or when placing or removing a firearm from any Incognito products, and Incognito highly recommends that all users employ a regular practice routine with a simulated training gun (and never with a loaded firearm) to increase safety and familiarity with their Incognito products.
The value of any defective product or material sent by Incognito or its agents, employees, manufacturers, or shippers is the full extent of liability, if any, borne by Incognito. Incognito does not warrant or represent that the products sold by Incognito comply with the provisions of any law or regulations, whether federal, state or local. It is solely the responsibility of the Purchaser to ensure compliance with any such laws or regulations which may affect his or her use thereof.
Many states and localities have laws and regulations governing sales and/or use of products for certain purposes, which may vary between neighboring areas or other parts of the country. It is solely the responsibility of the Purchaser to ensure compliance with any such laws or regulations. Before purchase and use of a product, the Purchaser should review the product application and all federal, state and local laws and regulations to ascertain that the product and use will comply with such laws and regulations that may affect his or her use thereof.
